Filing For Divorce
Are you filing for divorce? Wondering if you need a lawyer?
You have tried to
save your marriage?
You have
prayed
for your relationship to be
restored,
Maybe you have tried
counseling
or even a mediated separation but you still find yourself filing for divorce and facing the end of your
marriage.
The idea of handing over thousands of dollars for legal fees is like one more nail in the coffin.
Because divorce rates have grown so steadily over the last several years, the options for filing for divorce have increased. You no longer have to hire a lawyer. You can
do your own divorce,
use lower cost mediation or, if absolutely necessary, you can use a lawyer.
Can you honor God through the divorce process?
Of course you can. Many of God’s children find themselves dealing with divorce. Even if you caused the marriage to end, God is a merciful and forgiving God. His mercies are new each day. You cannot change what is in the past. You can, however, honor God from this point forward by how you react and behave in light of your divorce.
While it is tempting to want to exact revenge for all the hurt you have suffered, you honor God by leaving vengeance to Him (Romans 12:19).
Guard your tongue. Refrain from using abusive, foul language and putting your estranged spouse down, especially in front of your children (Ephesians 4:29).
Forgive.
Forgiving yourself and your ex shows Christ like character even in the midst of a life crisis.
Love.
Demonstrate God’s love even to the person who has caused you deep shattering pain (Luke 6:27-36).
Settle out of court. Paul puts to shame the Corinthians when he talks to them about taking each other to court. Why would the righteous ask the unrighteous to judge a dispute? To what end? Paul declares that we will one day judge angels. Surely that would mean there are those amongst us that are wise enough to judge matters of dispute between our brothers and sisters. Paul states that the Christian attitude would be to accept being wronged rather than committing a wrong oneself (1 Corinthians 6:1-8).
So where to you start?
Filing for divorce yourself
is possible if you are both able to work through the issues.
If there are matters of dispute that you cannot seem to resolve together, your next step would be to involve a mediator. This could be a trusted pastor or elder from your church or someone whose profession it is to mediate divorces.
If you cannot resolve the issues yourself and mediation fails, you may need to bring the matter to court. Even when you are able to settle things amicably without a judge, there may still be some things you will require legal help for such as changing ownership on any real estate owned.
